ProQuotar Terms of Service

About ProQuotar

ProQuotar is an estimating and business-management tool designed to help tradespeople and businesses prepare quotations, calculations and project information. These Terms apply between ProQuotar (referred to as "we", "us" or "our") and the tradesperson or business (referred to as "you" or "your") using the ProQuotar website, web app or mobile app.

Using ProQuotar

You may use ProQuotar to prepare estimates, quotations, invoices and project information for your own business. You are responsible for the accuracy of the information you enter and the outputs you rely on.

Account registration and security

You must be at least 18 and legally able to enter a contract on behalf of your business. You are responsible for keeping your account credentials safe and for any activity carried out through your account. Notify us at the support email listed on our website if you suspect unauthorised access.

Subscription, payment and cancellation

Paid plans renew automatically until cancelled. You can cancel from your account settings at any time — cancellation stops future renewals from the date the current billing period ends. Refunds are provided only where required by law or where we choose to offer one at our discretion. See the Subscription and Cancellation Policy for full detail.

Estimates, calculations and AI-generated content

ProQuotar is an estimating and business-management tool designed to help users prepare quotations, calculations and project information.

All prices, quantities, labour allowances, material requirements, timescales and other results produced by ProQuotar are estimates and guides only. They are based on the information entered by the user, the rates held within the user's account and, where applicable, AI-generated suggestions or third-party pricing information.

ProQuotar does not inspect project sites, verify measurements, confirm specifications or assess working conditions. Results may not account for incorrect or incomplete information, hidden defects, unforeseen site conditions, changes in material prices, wastage, access restrictions or other circumstances affecting the work.

User responsibility for quotations

The user is responsible for reviewing and checking every estimate, calculation and quotation before relying on it or sending it to a customer. The user must confirm that all measurements, quantities, material prices, labour allowances, tax calculations, profit margins, assumptions, exclusions and contractual terms are correct and appropriate for the relevant project.

ProQuotar does not guarantee that an estimate or quotation will be accurate, complete, suitable, accepted by a customer or profitable.

Material prices and third-party information

Material prices held in your ProQuotar account (whether entered manually, imported from a supplier or fetched from a third-party source) can change without notice. You are responsible for confirming current prices before committing to a quotation.

Customer contracts and Terms and Conditions

ProQuotar is not a contractor and is not a party to any agreement between a user and their customer.

Users are responsible for providing their own customer contracts, Terms and Conditions, cancellation information, payment terms, warranties and any other documents required for their business or under applicable law.

ProQuotar does not provide legal advice and does not guarantee that any documents created, uploaded or issued by a user meet the legal requirements applicable to that user or project.

Availability of the service

We aim to keep ProQuotar available at all times, but we do not guarantee continuous, uninterrupted or error-free access. We may carry out planned or emergency maintenance, and third-party outages (hosting, LLM, email provider) can affect availability.

Acceptable use

You agree not to use ProQuotar to break the law, infringe someone else's rights, upload malware, attempt to access other users' data, or scrape or resell the service. We can suspend or close accounts that misuse the platform.

Intellectual property

The ProQuotar platform, name and interface remain our property. You retain ownership of the data you upload (customers, jobs, quotes, documents). You grant us the licence needed to run the service on your behalf (store, process, back up).

User data and privacy

We handle your personal data as described in our Privacy Policy. You are the data controller for the customer data you upload; we act as the processor when we handle it for you.

Limitation of liability

Estimates and quotations produced through ProQuotar are used at your business risk. To the fullest extent permitted by law:

- We are not responsible for losses caused by a user failing to check an estimate or quotation before sending it to a customer. - We are not responsible for incorrect measurements or information entered by a user. - We are not responsible for outdated or changed material prices. - AI-generated suggestions must be reviewed by the user before use. - We are not responsible for hidden defects, unforeseen site conditions or changes to the project. - We are not responsible for disputes or contractual issues between a user and their customer. - We do not guarantee continuous, uninterrupted or error-free access. - Our total liability to you for any claim arising from your use of ProQuotar is limited to the amount you paid us for the service in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability where doing so would be unlawful (including for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation).

Account suspension and termination

We can suspend or terminate an account for material breach of these Terms, non-payment, or where the law requires us to. You can close your account at any time from account settings; we will retain data as required by law.

Changes to these Terms

We may update these Terms from time to time. Non-material updates take effect on publication. Material changes require you to review and accept the new version before continuing to use the platform. The version and effective date are shown at the foot of every published version.

Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local law provides otherwise.
